PHILIBERT, a simplified joint stock company with a capital of €15,244.90, whose registered office is located at 12 rue de la Grange 67000 Strasbourg, registered under the number RCS Strasbourg 313 642 613 (hereinafter the "Organiser"),
is organising an online game from 15/04/2022 to 18/04/2022 at 23:59, accessible on its website https://www.philibertnet.com/fr/, ("hereinafter the "Game").
Participation in this Game implies full and complete acceptance of these rules by the Participants.
This Game is open exclusively to persons of legal age on the date of their participation, residing in metropolitan France (including Corsica), Belgium and Switzerland (hereinafter the "Participants").
Persons who do not meet the above conditions are excluded from the game, as well as members of the staff of the "Organiser", and any person who has directly or indirectly participated in the design, production or management of the game, as well as their partners and members of their families: direct ascendants and descendants or other relatives, whether or not living under their roof.
Only one participation per person is allowed during the duration of the Game (same name, same address).
The Organiser reserves the right to ask any Participant to provide proof of the above conditions.
Any person who does not satisfy these conditions or who refuses to provide proof will be excluded from the Game and, in the event of winning, will not be able to benefit from the prize.
Participation in the Game implies full acceptance of these rules.

Any participation made contrary to the terms of these rules will render the participation invalid. Any participant suspected of fraud may be excluded from the competition by the "Organiser" without having to justify this. Any identification or participation that is incomplete, erroneous or illegible, whether intentionally or not, or that is made in a form other than that provided for in these rules shall be considered as invalid. The same penalty shall apply in the event of multiple participations.
The prize to be won is: a gift coupon (in the form of a voucher) for a Game Cruise with a total value of one thousand eight hundred and eighty-two (1,882) euros including tax (hereinafter the "Cruise").

The value of the prizes is determined at the time of drafting these rules and cannot be contested as to their evaluation.
All costs incurred after the game, in particular for the maintenance and use of these prizes, shall be entirely at the winner's expense.
At the end of the competition, a draw will be held on 20/04/2022 via the website https://www.random.org/.
The Winning Participant will be informed by e-mail to the address linked to the Philibert account used when registering for the competition.
The Winning Participant must provide the Organiser with his/her postal address within 15 days of being notified of the prize by e-mail so that it can be sent to him/her by post.
In the event of undelivered returns, the prize will remain at the disposal of the Winning Participant for 15 days. After this period, he/she will no longer be entitled to it.
The Winning Participant undertakes to accept the prize as offered without the possibility of exchange, in particular for cash, other goods or services of any kind whatsoever, or transfer of the benefit to a third person. Similarly, this prize may not be the subject of requests for compensation.
The Organiser reserves the right, in the event of the occurrence of an event beyond its control, in particular linked to its suppliers or to unforeseeable circumstances, to replace the advertised prize with a prize of equivalent value. The Winning Participant will be kept informed of any changes and waives in advance any claim in this respect.
For all purposes, it is specified that the Organiser will not provide any service or guarantee related to the use of the prize.
The personal data collected from each Participant, both during participation in the Game and, where applicable, during the awarding of a prize, are subject to the provisions of the amended French Data Protection Act of 6 January 1978 and the European Regulation on the protection of personal data (RGPD) n°2016/679.

The personal data of the Participants will be recorded and used by the Organiser to:
(i) To record their participation in the Game and to enable the prizes to be awarded;

Who are the recipients of the Participants' personal data?
In accordance with the provisions of the RGPD, the Organiser is entitled to disclose Participants' personal data to external subcontractors who act on behalf of and on the instructions of the Organiser (in particular service providers, technical partners for the purpose of delivering the prizes) or to share Participants' personal data with its subsidiaries (for the purpose of delivering the prizes and/or, subject to the Participants' express prior consent, in order to better serve and inform Participants about new products and services of the Asmodee group).
In this context, Participants' personal data may be transferred outside the European Economic Area (EEA) to countries that do not offer a level of protection equivalent to that of the EEA, such as China, the United States, Canada, etc. In the absence of an adequacy decision from the European Commission, the transfer of personal data will be governed by the transfer mechanisms provided for by the legislation in force for the adequate protection of personal data (e.g. adequacy decision, signature of the European Commission's standard clauses where applicable, etc.).
How long will the Participants' personal data be kept?
The Organiser shall keep the Participants' personal data only for as long as is necessary to fulfil the purposes described above, in accordance with applicable law. The Participants' personal data is then archived for the period required by the legal provisions in force and for the management of any complaints and/or disputes. The Participants' personal data will then be deleted or anonymised for statistical purposes.
What are the rights of the Participants?
In accordance with the legal provisions in force, and under certain conditions, each Participant has the right to access, delete and rectify personal data concerning him or her and may object at any time to the processing of personal data concerning him or her. They may be sent free of charge to any person who requests them from the Organiser. The Organiser reserves the right to extend, shorten, modify or cancel the game at any time, particularly in the event of force majeure, without the participants being able to claim any compensation. The rules will then be modified accordingly and made available to participants under the same conditions as these rules.
The reproduction, representation or exploitation of all or part of the elements making up the Game, including these rules, is strictly prohibited.
All brands, logos, texts, images, videos and other distinctive signs reproduced on the site as well as on the sites to which it allows access via hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the whole world. Their unauthorised reproduction constitutes an infringement punishable by law.
Any unauthorised reproduction, in whole or in part, of these brands, logos and signs constitutes an infringement liable to criminal sanctions.
The Organiser shall not be held liable in the event of force majeure or a fortuitous event beyond its control.
The Organiser shall not be held liable if, due to force majeure or any event beyond its control, the Game covered by the Rules were to be cancelled, extended, shortened, postponed or modified or if the Participants are partially or totally deprived of the opportunity to participate or if the Winning Participant is deprived of the benefit of their winnings.
The Organiser and its service providers and partners may not be held responsible for any incidents that may occur in the use of the prize by the Winning Participant or their guests once the Winning Participant has taken possession of it.
Any additional cost necessary to take possession of the prize shall be borne entirely by the Winning Participant, without the latter being able to claim any compensation from the Organiser or from the service provider or partner companies.

Except in the case of obvious errors, it is agreed that the information resulting from the Organiser's systems has evidentiary force in any dispute as regards the connection elements and the computer processing of said information relating to the Game.
Any claim must be made in writing, to the exclusion of any other method, to the head office of the Organiser, as specified in Article 1 of these Rules, within 30 (thirty) days after the end of the Contest. After this date, no claim will be accepted.
Any dispute arising in connection with the Game will be subject to an attempt at amicable settlement between the Organiser and the Participant. If no agreement is reached, the dispute will be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure.
No telephone or written enquiries regarding the interpretation or application of the Rules, the mechanisms or terms of the Game or the Winning Participant will be answered.
